Drug Trafficking

Trafficking is mostly defined as giving, delivering, or providing a drug to another person. Neither money nor profit needs to be proved in the transaction to establish a trafficking charge. Somebody may be liable if they are simply promoting the distribution of the drug.

  • Giving a drug to another person for safekeeping.
  • Offering to sell a drug to an undercover police officer (note that the actual sale need not take place)
  • Lending money to someone to purchase drugs for purpose of trafficking.
  • Actual sale exchanges or trades of money or items for drugs.

Sentences for Drug Trafficking vary depending on the drug type and the quantity. Some other factors that contribute are whether the sale was connected to a criminal organization, whether weapons were involved, or violence was used. The maximum sentence for cocaine trafficking, for example, is life in jail.
