Human Trafficking

Human Trafficking is defined as someone who recruits, transports, transfers, receives, holds, conceals, harbours, exercises control, direction, or influence over the movement of a person, for the purpose of exploitation. Therefore, a charge of Human Trafficking can arise over a wide variety of scenarios. Most common is the forced exploitation into prostitution as a sex worker.

Exploitation in this context means the victim provided their labour or services because they feared for their safety or the safety of loved ones. This can extend to the use of deceit, or threats such as the removal of one’s organs.

It is not a defence to claim that the person consented to the exploitation. If the exploited person in question is under 18, then the sentence by the Court will be harsher.

Depending on the circumstances of the case, jail sentences vary. That said, a two-four-year jail sentence is certainly not uncommon for a first-time conviction of Human Trafficking. Other Factors considered are involvement of firearms, weapons, age of victims, first or repeat offences. The maximum sentence is up to life in jail.
