Drug Possession charges are serious offences. The severity is determined by what Schedule the drugs someone is charged with is classified as in the CDSA (Controlled Drugs and Substances Act). Schedule 1 is more serious and encompasses drugs such as Heroin, Oxycodone, and Cocaine. Schedule 2 is less serious such as certain prescription drugs etc. Other factors such as the quantity of drugs on one’s person also contribute to the seriousness of the charge.
To prove a Drug Possession Charge, the Prosecutor must prove that the accused had knowledge and control over the drugs in question. For example, just because you were aware that your friend had multiple ounces of cocaine in his car, and you were arrested with him, does not mean that you are guilty of drug possession. The Crown would have to prove as well, that you had some power of authority over the drugs seized.

Yes, cannabis is legal but personal possession is limited to a certain amount. Under the Cannabis Act, if you possess over 30 grams of Marihuana for example, you can be charged with possession of this restricted substance.
