Sexual Interference

Sexual Interference

This offence is charged when the complainant is less than 16 years old and claims they have been touched directly or indirectly for a sexual purpose. This charge often is accompanied by a charge of Sexual Assault as well.

This occurs when a person invites, asks, or in a manner suggests that a person under 16 years old touch themselves or another person for a sexual purpose.

Similar to Sexual Interference and Invitation to Sexual Touching, Sexual Exploitation is a law that makes it illegal for the acts described above to happen to a person between the ages 16-18. Sexual Exploitation is frequently linked when the accused is a person in a position of trust or authority (parent, family elder, coach, teacher, clergy, etc). The court considers factors such as age difference, the relationship between the accused and complainant and the level of control over the complainant.

At East Law we have won cases on charges such as Sexual Interference, by running the Defence that the accused mistakenly thought the Complainant was over the age of 18 years old. We have extensive experience in this regard.
