Highway Traffic Act (HTA) Offences

These charges relate to driving motorized vehicles from transport trucks to e-bikes, to scooters. A conviction under the HTA will not result in a criminal record. However, these charges can still be bad overall for you with fines, driver’s license suspensions, huge insurance increases, and potentially jail time.

Speeding up to 49km/hr over usually results in fines and loss of license points. Too many point losses can result in suspension. Any speeding ticket conviction will affect your insurance costs. East Law can fight these charges and help keep you on the road and your insurance bill down.

Commonly called “Over 50”, racing, or stunt driving. This brings serious consequences. First, the mandatory loss of vehicle for 7 days by roadside seizure, towing and impound. Apart from the loss of transportation the storage fees are not cheap. Convictions can result in fines that can be as much as $10,000 and the loss of 6 points off your license. Insurance will skyrocket. There is also potential jail time of up to 6 months.

Operating a motor vehicle on a road without proper attention to care and control that is expected is expected of the driver can result in this charge. The penalty is losing 6 points, high fines, possible jail and/or a license suspension. Later, insurance will also go up substantially.

Driver’s must be licensed. Driving while suspended can result in heavy fines, repeat offenders can be subjected to jail.

“Distracted Driving” is using any hand-held (phone, gaming, GPS, etc) device while operating a motor vehicle. A device that has a safe hands-free mode is excluded, but a smartwatch was found by the Court to not be a hands-free device.

Owners of motor vehicles are required to have insurance to operate on public roads. Fines are heavy to dissuade anyone who may think of skipping the insurance cost. Fines for this will likely increase insurance significantly.
